Historical background of the importance of licencing and royalties in the music industry
Music licencing and royalties has been around for a long time. They are very important to the running of the music industry; there are always law suits and other legal things going on to do with licencing and copyright and royalties. One of the first federal laws on copyright was put in place in the USA in 1790. The name of this law was the Copyright act of 1790; this made it possible to give protection to original scores and
lyrics.
In the time of Beethoven and Bach they were not as advanced and as sophisticated as we are today in terms of licencing and royalties. At that time, the composers gave or assigned there music to the music publishers in exchange for a payment. Every time the publisher sold a book of
sheet music they would receive royalties form the money. If we are to move on a little bit from this era of classical music and into a more modern age where a new way of listening to music has been invented. This is called the grammar phone. Because of this the publisher cannot only make money by selling books of music but the publisher can also make money by selling records. Recordings were made by a recording of the composer composing his or her music. In the same way as before, the composer also gets paid royalties of every sail of their sheet music or there recording that there is. Also, just like before the publisher will only sell the customer the recording of the music for their own personal use. If the customer is actually a business of some description and they are purchasing the music to pay to the public in some way, like in thee shop or in there theatre or (jumping ford a few hundred years) on the radio. If this was the case then the performers would want to receive performance royalties. For example: if the music is used in a theatre then the owner of the theatre would have to pay performance royalties for the music.
When the invention of film came about the whole industry took a leap as there was instantly so much more opportunities for different pieces of music to be put over the images in the films and shown to the public and then there would be the case of the royalties that the artist gets for their music being shown to the public in a film. This kind of music to film is called the record picture. When the music is used on a film or on the
television or on the internet to film and to videos there is a whole pieces that haves to take place before this can happen. This process starts with the music publisher. The music publisher licences the music to the production company who is making the video or the film that the music is going to be used over the top of. When this happens this is called the music publisher is granting a synchronisation licence.
Now days there are many media outlets for the performance music in film and video. There are so many difference way in which music is broadcasted and shared with members of the public. We have the internet and we have the radio and we have thousands of television channels around the wold and many more things. Every time a piece of music in the world is played or is on a film or is on a video on the internet or other things like that there is a song writer or a band sitting there somewhere who is getting money in the form of royalties from their music being shown to the public.

PRS – Performing Right Society
PRS is a huge non-profit organisation that helps musicians and song righters and bands to get the royalties that they deserve when there music is played to the public. This goes for lots of different ways there music can be played to the public. It goes for whenever it is played in a film or whenever it is played on a television show or if it is played on the radio or even if it is on a playlist in a shop or in any kind of place where lots of members of the public will hear it. If you are a musician then signing up to PRS will benefit you in a lot of ways. One of the most obvious benefits is the financial benefits that it provides. If you are a member and your music is being played in various things or even if you are out playing it at gigs or busking then you will be paid 4 times a year. Once every 3 months. You probably won’t get a lot of money to begin with but it is very possible to get a lot of money. When you’re songs are used on BBC radio stations you get paid 26 pounds a minute, PRS take 13 percent of this. So it is possible to make a lot of money if you’re songs take off and people buy you’re music. PRS rules require that at least 50% of the performing income is paid directly to the performer. This means that the money does not go through the publishers hands and the song writer dose make some money.

Comment critically on PRS
PRs is a non profit organisation. It pays out a lot of money to the people who have rightfully earned it but there is a large chunk of money that they take as commission and all of the percentages that they take of each transaction must add up and i don’t know what they do with that money. No one knows really but other than that all that PRS dose is benefit the music industry.
One of the things that i don’t think is great about PRS. That is that in order to start getting payment and be a member and get you’re foot in the door in the music industry. You have to have three songs at least on iTunes and you have to have already established yourself as an artist.

Distribution or royalties to righters and publishers
Royalties and the money that musicians and song righters and publishers have earned from the use of there music in tv and being played in public and pretty much every thing to do with there recordings will be paid out via a bank transfer from prs. This is the most common way however there are other ways to clamed the royalties that you deserve from you're music and a lot of musicians do.

Piracy and illegal downloading
Piracy and illegal downloading is a massive problem in the music industry because there is almost no way of stopping it because when ever the police take a torrent site don there will be a proxy for it almost instantly that enables internet uses to do exactly the same thing and download music for free. Downloading music for free is cheating the music industry and the artists who have put a lot of work into there music of money and it is bad because it means that even though musicians music is being downloaded and played and enjoyed by masses of people, the musician or song righter ect will not be receiving the correct amount of royalties and will not be getting the money they deserve.
